The State of Arizona and Governor Janice K. Brewer presented yesterday a appeal in the federal court of appeals for the Ninth Circuit, which proposes to cancel the preliminary injunction which was issued by U.S. District Judge Susan Bolton on Wednesday. Along with the appeal was filed a motion to expedite the delivery of legal briefs and schedule court hearings.
The appeals court is expected to hear legal arguments between August and September to determine whether Judge Bolton abused her discretion in blocking four sections of S.B. 1070. The appeals court decision may be appealed to the U.S. Supreme Court, which could review the case in October when it returns from its summer recess.
